Last December 6, Mtre Bryan-Eric Lane, in collaboration with Éditions Yvon Blais, gave a webinar on remedies against previous sellers for latent defects, and remedies against stakeholders involved in the construction of a building.
In this webinar, Mtre Lane discusses a property owner’s right to bring a claim against previous sellers under the legal warranty of quality. Mtre Lane discusses the provisions of section 1442 of the Civil Code of Québec and the principles set forth by the Court of Appeal in Hay v. Jacques in 1999, as well as subsequent decisions dealing with remedies for latent defects against previous sellers and the necessary conditions for seeking the liability of a previous seller under the legal warranty of quality.
Mtre Lane also discusses the impact of a sale with exclusion of warranty and the specific rules applying to a manufacturer within the meaning of section 1730 of the Civil Code of Québec, in particular a contractor involved in the construction of a building.
This webinar also covers actions in warranty in respect of latent defects, the specific rules applicable and the obligations applicable to a plaintiff in warranty regarding notice and formal demand.
